Arbitration is a form of Alternate Dispute Resolution where the arbitrator(s) conducts an information gathering process, which may include document exchange, briefings by the disputing parties and testimony from witnesses in order to assist him/her to arrive at a fair and equitable resolution of the dispute. At IDR, the arbitrator(s), a neutral party agreed upon by the participants in the dispute, hears and weighs the evidence presented and renders a decision. The arbitrator’s decision is generally binding on the disputing parties. During the arbitration process, the disputing parties may be represented by counsel. In many ways, an arbitration proceeding is much like litigation before a judge. However, unlike a court proceeding, which is generally public, the IDR arbitration proceeding is private and confidential. The decision rendered under binding arbitration is, like a court ruling, enforceable by the legal system.
