Which types of disputes lend themselves to arbitration?

There are several broad categories of disputes or conflicts that are suitable for arbitration.

Business Disputes

More and more, dispute resolution clauses are being written into contracts of all kinds. Increasingly, these contract clauses require that disputes be settled by binding arbitration. This allows the parties of the contract to select a subject matter or technical experts as the arbitrator

Construction disputes are particularly amenable to arbitration, given their technical nature and specialized vocabulary.

Types of real estate disputes typically submitted to arbitration include home purchase and sales agreements; listing agreements; leases; real estate partnerships and joint ventures and real estate valuation.

Family / Probate

Family issues involving divorces, legal separation, custody and parenting conflicts as well as grandparent visitation, disputes involving estate planning and/or distribution and conflicts about elder care for a loved one are best settled using mediation. However, there are times when a single issue threatens to derail the mediation process. When the parties in mediation hit an impasse or are unable to resolve a particular family or probate issue, arbitration can be used resolve the impasse on that single issue so that mediation can continue.
