Collaboration

Using the combined efforts of its team of qualified professionals (i.e. attorney, financial planner, industry expert, mental health professional, etc.) the IDR professionals, with all parties, work to comprehensively resolve the existing disputes in a mediated environment.

The practice of the Collaborative Law process generally follows one of two basic paradigms, both of which are based upon an agreement to settle disputes out of court.

  1. The Collaborative attorneys, representing their respective clients, agree to negotiate in good faith and use their best efforts to settle the dispute out of court. The attorneys both facilitate the collaborative process while separately providing advice to their clients.
  2. A collaborative team approach is used where the collaborative lawyers work with others to help their clients through the process. This can involve a team that may consist of several members besides the parties’ attorneys, including financial specialists, therapists, life coaches, subject matter experts, guardians for children, etc.

IDR’s professionals’ areas of expertise, training and collaboration experience allow them to work successfully with either of the above paradigms.

  • IDR’s attorney is trained in collaborative law, is a trained mediator and is committed to resolving collaborative disputes out of court.
  • IDR’s CDFA™, who is also a trained mediator, can assist the parties in reaching a financial settlement that meets their short term needs and concerns and establishes the opportunity for them to achieve their long term financial goals.
  • With its extensive strategic alliances with subject matter experts, IDR’s professionals can bring together a team of professionals to resolve disputes in areas such as students and schools, small businesses, family owned businesses, in family matters that pertain to elder care, wills, civil unions, prenuptials, and divorce, and commercial disputes, including intellectual property, contracts and land use.
